Mayor Schummer called the meeting to order at 6:00 p.m. and a quorum was present.

It is important to begin each public gathering with a Land and Territorial Acknowledgement, to recognize the Indigenous people for being good stewards of the land and environment, here where we are meeting today. The Township of Brock has traditionally been a hunting and fishing ground for First Nations people. We reside on and benefit from the Williams Treaty Territories, on the land of the Mississaugas and Chippewas. May we share the land as long as the sun rises, the grass grows and river flows.

Council advised that the Beaverton Lions Club Winter Carnival would take place February 4, 2023.

Communication Number 25/23

Inspector Mike Brown, Staff Sergeant Todd Wilson, and Constable Colin Granger, Durham Regional Police Service (DRPS), were in attendance. Inspector Brown provided a presentation which included the following:

Durham Regional Police Services, North Division cover more than fifty percent of the entire land mass for Durham Region. The North Durham area encompasses 1,200 square kilometers with 60,00 residents in Brock, Scugog, Uxbridge and the Mississauga's of Scugog Island First Nation.

  • Roadway Safety
    • tickets, traffic stops and traffic cautions have increased significantly from 2021
    • 17 hours dedicated to R.I.D.E. program in 2022
  • Compliance Checks
    • 107% more compliance checks conducted compared to 2021
    • using Firearm Bail Dashboard
  • Calls for Service
    • 28% decrease in emergency calls since 2021
  • General Occurrences
    • 20% decrease since 2021
  • Community Initiatives
    • Proactive patrols: 22 hours at community events, 70 hours foot patrol, 94 hours bike/ATV/snowmobile patrol, and 297 hours proactive property checks
  • 'store front' police offices located in Beaverton and Uxbridge

  • police staffing resources
  • surveillance cameras on residential streets
  • the Overt CCTV for Beaverton
  • Coffee With a Cop program
  • trails patrol
  • resident to report crimes to DRPS online
  • increase in ATV enforcement by DRPS

The purpose of this Statutory Public meeting was to provide the public with an opportunity to provide comments on the proposed repeal of the ATV By-Law Number 1954-2005-PP.

The Clerk/Deputy CAO provided the Proposed ATV By-Law Repeal presentation which focused on the following:

  • types of all terrain, off road vehicles (ATV/ORV) for single and multiple riders
  • current By-law 1954-2005-PP designates what time of year ATVs/ORVs can travel the roads
  • municipal parks are posted to indicate that ATVs/ORVs are not permitted
  • Ministry of Transportation Regulation 316/03 requirements
  • where you can ride ATVs/ORVs if the existing By-law is repealed
  • there are no organized ATVs/ORVs trails in Brock
  • should By-law 1954-2005-PP be repealed, the operation of ATVs/ORVs would be regulated under the Highway Traffic Act Ontario Regulation 316/03 and subject to local police enforcement

Council members discussed and deliberated on the following:

  • enforcement under the Highway Traffic Act
  • dirt bike requirements
  • extra charges with respect to stunt driving
  • increased enforcement resulting from complaints submitted to DRPS

  • support for repealing By-Law 1954-2005-PP and it would promote tourism and recreation
  • there are no organized ATV trails in the Township of Brock
  • there are municipal streets with no sidewalks and pedestrians walk on the road
  • was strategic information gathered from other municipalities with no sidewalks where ATV's are permitted on the roads
  • concern for pedestrian safety on the roads with no sidewalks
  • support repealing By-Law 1954-2005-PP and have the DRPS enforce the regulations
  • support for repealing By-Law 1954-2005-PP

    BE IT RESOLVED THAT Council approve the 2023 Capital Budget as discussed during the Budget Committee meetings held on January 16 and 30, 2023 at a total of $5,489,700, with the list of Capital Projects attached as Appendix 1 along with the approved funding source for each project attached as Appendix 2; and

    THAT Council approve $1,080,000 be transferred from the Tax Rate Stabilization Reserve to the Capital Reserve Fund - Roads; and

    THAT the 4 Year Road Rehabilitation Program be funded 50% from the Capital Reserve Fund - Roads, and 50% from the Ontario Community Infrastructure Fund Grant; and

    THAT the Committee of the Whole recommendations from the January 30, 2023 3:00 p.m. meeting be adopted with respect to:

    • Item 7.7.1. Recommendations from Report 2023-GG-002, and
    • Item 9 Rise from Closed Session, Rise and Report - various appointments to Durham Region Committees

    • Blue Rodeo Shows at the Sunderland Memorial Community Centre on May 26 and May 27, 2023;
    • Car Draw at the Sunderland Memorial Community Centre on June 10, 2023;
    • Summer Fest at the Sunderland Volley Ball Court on June 23 and June 24, 2023;
    • Opry Night at the Sunderland Town Hall on October 14, 2023; and

    THAT approval is subject to the Lions obtaining an SOP for the events and compliance with all regulations of the Liquor Licence Board of Ontario; and
